India is looking at non-personal data as an economic asset, and the data of Indian citizens as a national resource. Non-personal data largely includes analytics and data sets which do not identify individuals. For example, traffic issues can be determined on the basis of traffic data, the spread of diseases can be ascertained from public health information, e-commerce data can help other retailers determine customer demand and banks make lending decisions, farmers can understand facets of the soil fertility to determine which crops to sow. Such data is currently not protected under any privacy framework.
MEITY has formed a committee on non-personal data, which is hosting private consultations on issues related to non-personal data, including localisation, providing/mandating access to this data, anonymisation, and how access to this data may be regulated. Our discussion will delve into:
- Competition and intellectual property issues,
- Privacy risks and security issues, and
- Regulatory mechanisms to govern non-personal data
Meanwhile, the Personal Data Protection Bill, 2019, is listed for introduction in the Winter Session of Parliament, set to begin on November 18, 2019. It is currently unclear if the Bill will deal with non-personal data.
