The Ministry of Information and Broadcasting has set up a committee to look into online content regulation, looking into a regulatory framework for (i) online news portals and aggregators infotainment sites, (ii) digital broadcasting/entertainment and media aggregators. This comes at a time when there is growing concern around fake news, and there has been a rapid growth in online content sites in India, apart from increased consumption of content. While the Internet has supported growth of speech, it is the presence of a safe harbor for platforms, based on the view that platforms are a mere medium of communication of content, that has enabled large amounts of content creation and consumption, of both professional and amateur content. In addition, there is a clear distinction between the restrictions on traditional sources of news and information and entertainment, and those online. The challenge lies in the prevention of creation, sharing and consumption of illegal content and acts, while still preserving both the freedom to create, consume and share content. The potential impact on the ubiquity of content on the Internet and balkanisation of the open web need to be looked into.…
